To me flag burning is like a white person saying the "N" word. It should be constitionaly protected as free speech, but no should pity you if your ass gets kicked for doing it.
On that note, I have ceremonially burned many flags to properly retire them as per the US Flag Code. If the flag was alive ceremonial burning and anti-America burning should be equally as wrong.

Oh, yes, the military burns many flags, sometimes ceremoniously, sometimes just as a chore, but always privately.
I may offend some people for saying this, but I honestly can't see what's the big deal with flag burning.
I doubt the flag means the same thing to any two Americans; one might find it sacred and another garbage, and because this is America that ought to be accepted.
I personally have no desire to damage a flag, but I think other people should have the right to fire one up if that's really the statement they want to make (and it's their personal property). It doesn't actually hurt anyone.
Also... the USA has spent a good deal of time shitting all over other people's sacred things/beliefs/symbols, and our flag is not especially precious. It seems kind of silly that it's okay to put a flag on a t-shirt or lunchbox or sneakers, but if it's nylon and belongs on a flagpole then suddenly it's a big deal!
The flag is a living thing in the sense that it represents an idea, and that idea is alive.
This is like V for Vendetta. V says 'ideas are bulletproof' but they're obviously not flame retardant 'cos he got himself all burned up.

The American flag, as a symbol of unity, is dead. So many racist, hate-mongering, small-minded "patriots" have paid lip service to it while wiping their ass on what it stands for that a lot of people find it slightly shameful to even be associated with it.
Thanks to Hawker I have an answer. I've known for a long time you're not to fly a tattered flag, Burning it as disposal isn't an issue, in fact it's recommended. Why?

Well, my living flag goes to the BP and gets me smokes when I ask it politely.
It's been starting to date lately, and we are concerned about its choices. We are very worried that it might take up with the "Hammer-&-Sickle" crowd - A horrible peer group.

Only that the flag is considered a SYMBOL. To be a living thing it has to breath, digest and have bodily functions. Well, think about this, animals are living things............see the problem?
The belief that inanimate objects are, in fact alive is called, "animism." Most people grow out of it by the time they reach 1st or 2nd grade. Perhaps that's when your brain stopped developing Beowulf.
Then again, animism is a principle in certain forms of spirituality. So Beowulf, are you ready to tell your friends on Free "The USA is a Christian nation dammit" Conservatives that you subscribe to animism? Or are you afraid?
As a symbol of the nation the flag should be treated with a degree of respect. It was considered disrespectful to allow a flag to touch the ground when raising or lowering it , or when being handled in ceremonies like funerals.
That said old damaged flags were burned rather than thrown in the trash.
Even a cotton flag is not a living thing, so murder is not an option.
